Privacy policy

  1. Introduction
    1. Omnia Group (Pty) Ltd (“Omnia”), acting through its Bulk Mining Explosives division (“BME” or “we” or “our” or “us”) are offering you access to the internet platform (“Platform”) and the application (“App”) to use for your own personal use without cost. By accessing the Platform and/or downloading or using the App, this privacy policy (“Privacy Policy”) and our terms and conditions of use, (“Terms”) will automatically apply to you. You should therefore read both this Privacy Policy and the Terms carefully before accessing the Platform, downloading or using the App and/or purchasing Premium Products.
    2. This Privacy Policy must be read together with the Terms, and sets out the basis on which any “Personal Information” (defined in paragraph 2 below) we collect from you, or that you provide to us, will be collected, used, stored and “Processed” (defined in paragraph 3.2 below). Unless defined elsewhere, terms in this Privacy Policy shall bear the same meaning ascribed to them in the Terms.
    3. This Privacy Policy does not apply to (i) any information which is not “Personal Information” or (ii) other parties' applications, websites, products or services, such as websites linked to, from or advertised on the Platform and the App (together, “System”), or sites which link to or advertise the System.
    4. Omnia is committed to protecting and respecting your privacy. We strive to ensure that our use of your Personal Information is lawful, reasonable, and relevant to our business activities, with the ultimate goal of improving our services and your experience.
  2. Personal Information
    1. For purposes of this Privacy Policy, “Personal Information” means information relating to an identifiable, living natural person, and where applicable, an identifiable existing juristic person, including, but not limited to:
      1. information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person;
      2. information relating to the education or the medical, financial, criminal or employment history of the person;
      3. any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person;
      4. the biometric information of the person;
      5. the personal opinions, views or preferences of the person;
      6. correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;
      7. the views or opinions of another individual about the person; and
      8. the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person.
  3. Other information which should be considered "Personal Information" for purposes of this Privacy Policy includes:
    1. "device and device event information": We may collect information such as your Internet protocol (“IP”) address, unique device identifier, the type of device which you used to access the  System (for example, a tablet or smart phone, and which type thereof, “Access Device”), the geographic location from which you accessed the  System (that is, the geographic location of your Access Device), hardware model and settings, operating system type and version, browser language, system activity, crashes;
    2. "log information": When you use the  System, we may automatically collect and store certain information in server logs (that is, our web servers automatically record and maintain a log of their activities when users access the  System), which may include your "site activity information", such as details of how, when and for how long you accessed the  System, what links you went to, what content you accessed, the amount of content viewed and the order of that content and the amount of time spent on the specific content;
    3. "location information": We may use various technologies to determine your actual location, such as geographical data from your Access Device (which is usually based on its GPS or IP location).
  4. For purposes of this Privacy Policy, any Personal Information that has been “de-identified” by us such that it (i) cannot be used to identify you, or (ii) cannot be used or manipulated by a reasonably foreseeable method to identify you; or (iii) cannot be linked by a reasonably foreseeable method to other information that identifies you is not “Personal Information” and therefore not subject to this Privacy Policy.
  5. Consent to Processing Personal Information
    1. You consent to Omnia “processing” your Personal Information on the terms and conditions set out in this Privacy Policy. Accordingly, you provide us with your express consent and agreement that we may collect, get, receive, record, organise, collate, store, update, change, retrieve, read, process, and use your Personal Information in the ways set out in this Privacy Policy. 
    2. Without in any way limiting the generality of paragraph 3.1, you further agree that Omnia may accordingly engage in any operation or activity or any set of operations, whether or not by automatic means, concerning your Personal Information, including:
      1. the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use of your Personal Information;
      2. merging, linking, restricting, degrading, erasing or destroying Personal Information, (together, “Processing” your Personal Information).
    3. If you do not agree with this Privacy Policy, or are concerned about any aspect as it relates to your Personal Information, please immediately cease using the System.
    4. Paragraphs 3.1 and 3.2 above have important legal consequences for you. By granting your consent in accordance with those paragraphs:
      1. you know and accept that you are giving up certain parts of your right to privacy;
      2. you will not be able to take any action against us for using your Personal Information in the way that you have given us permission, even if you suffer loss or damage as a result thereof.
  6. Ownership of Information and Data
    1. By granting the consents referred to in paragraph 3 above, you in no way grant any rights of ownership in any to your Personal Information to us. You remain the owner of all of your Personal Information at all times.
    2. Subject to paragraph 4.1 above, you agree that we may aggregate and anonymise any or all your Personal Information for internal or research purposes to enhance the capability and functionality of the System and its and associated services. To the extent that we do so, we will always “de-identify” your Personal Information so that it cannot be identified as your Personal Information. Once so anonymised and no longer Personal Information, Omnia shall be the owner such aggregated data.
  7. Withdrawal of Consent
    You remain entitled at any time to withdraw your consent to us Processing your Personal Information, and may do so by contacting Omnia at the address mentioned in paragraph 17.5 below. We will use our reasonable commercial endeavours to action your request as soon as possible in the circumstances. In this regard, you should be aware that by withdrawing your consent, you will no longer be permitted to access the System.
  8. When Will We Process Your Personal Information?
    Personal Information may be Processed by us in several ways, including, when:
    1. you access or make use of the System;
    2. you contact us, by email or telephonically, with any queries;
    3. you provide us with feedback about the System; and
    4. you submit your Personal Information to us for any other reason.
  9. How Does Omnia Use Your Personal Information?
    We will use your Personal information:
    1. to maintain and update our customer, or potential customer, databases;
    2. to establish and verify your identity on the System;
    3. to fulfill your requests for certain services provided by Omnia or Omnia Group (Pty) Ltd to you from time to time (“Services”);
    4. to diagnose and deal with technical issues and customer support queries and other user queries, such as problems with our server, determine the optimal and fastest route for your Access Device to use in connecting with the System, and to administer, maintain and secure the System;
    5. to detect, prevent or deal with actual or alleged fraud, security or the abuse, misuse or unauthorised use of the System and/or contravention of this Privacy Policy;
    6. to provide you with the latest information about the Services, provided you have agreed to receive such information;
    7. to improve the System, analyse trends and administer the System, including requesting feedback on content and the Services, products, address any issues and liaise with users in that regard;
    8. to keep a record of our communications with you and your communications with us;
    9. to fulfill any contractual obligations, we may have to you;
    10. to improve your user experience and the overall quality of our Services;
    11. to customise the System to your preferences and tailor information and/or content for you to ensure that it is presented in the most effective manner for you and for your Access Device;
    12. to compile and use statistical information about you and other users and their access to and use of the System, browsing habits, click-patterns, preferences, and demographics which we may use to develop, provide and improve the System, including, recommendations to users and tailoring information and content for users;
    13. for security, administrative and legal purposes;
      and
    14. for other activities not specifically mentioned which are lawful, reasonable, relevant to our business activities and the minimum necessary and adequate for us to provide the System.
  10. Will My Personal Information Be Used for Marketing Purposes?
    1. If we obtain your prior consent, we may use your Personal Information for the purposes of:
      1. direct marketing of our own Services; and
    2. You are entitled to request that we cease using your Personal Information for the purposes of direct marketing, and we will provide you with the necessary functionality for you to do so with ease, each time we market to you.
  11. What Security Measures Are in Place to Protect My Personal Information?
    1. Although absolute security cannot be guaranteed on the Internet, we have and will maintain in place up-to-date, reasonable technical and organisational security measures to protect your Personal Information against accidental or intentional manipulation, loss, misuse, destruction or against unauthorised disclosure or access to the information we Process online.
    2. While we cannot ensure or warrant the security of any Personal Information you provide us, we will continue to maintain and improve these security measures over time in line with legal and technological developments.
  12. Storage and Transfer of Your Personal Information
    1. We store your Personal Information on our servers.
    2. If the location that Personal Information is transferred to does not have substantially similar laws which provide for the protection of Personal Information, we will take reasonably practicable steps to ensure that your Personal Information is adequately protected in that jurisdiction.
  13. Third Party Sites
    We include and offer third-party products or services within the System as part of the System’s subscription services. We are not responsible for the privacy practices of such third party's application or websites to which you may log in from the System.
  14. Security
    1. We take reasonable technical and organisational measures to secure the integrity of retained information, using accepted technological standards to prevent unauthorised access to or disclosure of your Personal Information, and protect your Personal Information from misuse, loss, alteration or destruction.
    2. You know and accept that the Internet is not absolutely secure and there is a risk that your Personal Information will not be secure when transmitting over the Internet. We do not promise that we can keep your Personal Information completely secure over the Internet.
    3. You also know and accept that we do not promise the complete security of your Personal Information. You will not be able to take action against us if you suffer losses or damages in these circumstances.
    4. We usually use encrypted servers to store all the Personal Information that we collect and such servers are either on our premises or on third party locations in jurisdictions which may not have comparable data protection legislation.
    5. From time to time, we review our information collection, storage and processing practices, including physical security measures, to keep up to date with good practice.
    6. We also create back-ups for operational and safety purposes.
    7. Even by taking the above measures when Processing Personal Information, we do not guarantee that your Personal Information is 100% secure.
  15. How Can I Find Out What Personal Information Omnia Holds About Me?
    1. To access the Personal Information, we have processed through the System that relates to you, visit the Blasting Guide application >> Profile Settings and update your personal details on the application.
  16. Use of The System by Children
    The System is not targeted at children under the age of 18, although we will collect data from any individual who downloads the application.
  17. Changes to This Privacy Policy
    1. From time to time, we may revise this Privacy Policy to reflect company initiatives, changes in the law or technology or changes in our practices regarding the Processing and use of Personal Information. You agree to review the Privacy Policy whenever you visit the System for any such amendments. Save as expressly provided to the contrary in this Privacy Policy, the amended version of the Privacy Policy shall supersede and replace all previous versions thereof.
    2. We will not use or disclose Personal Information provided to us pursuant to this Privacy Policy in ways other than the ones described above, without informing you and providing you with the opportunity to consent to such modified conditions concerning the use and disclosure of your Personal Information.
  18. General
    1. This Privacy Policy, together with the Terms, constitutes the whole agreement between you and Omnia concerning your use of the System.
    2. This Privacy Policy shall be governed by and construed in accordance with South African law and you agree to submit to the exclusive jurisdiction of the South African courts.
    3. Unless otherwise expressly stated, nothing in this Privacy Policy shall create any rights or any other benefits for any person other than you, Omnia and its group of companies. Omnia shall be entitled at any time on notice to you to cede and assign any of its rights and obligations in this Privacy Policy to any other company within Omnia’s group of companies.
    4. If any provision of this Privacy Policy is judged to be illegal, void or unenforceable due to applicable law or by order of a court of competent jurisdiction it shall be deemed deleted and the continuation in full force and effect of the remainder of the provisions will not be prejudiced unless a court of competent jurisdiction determines that the substantive purpose of this Privacy Policy is then frustrated, in which case you may contact Omnia at This email address is being protected from spambots.
